Drug Driving

It is an offence to operate a motor vehicle while under the influence of any drug or if there is a presence of any illicit drug in your oral fluid, blood or urine. Even if illicit drugs are consumed prior to the offence and your ability to operate a motor vehicle was not affected, you can still be charged with a drug driving office as some illicit drugs, such as marijuana, can remain in your system for up to 40 days.

Defences to a Drug Driving Charge

If you have been charged with a drug driving offence, do not assume you must simply plead guilty to the charge. You may be able to defend the charge for instance on one of the following grounds:

  • If the accused has a presence of morphine in their blood or urine they will have a defence available to them if the morphine was consumed for ‘medical purposes; or

  • The offence can be overturned on the basis of legal technicalities.
