Drug Driving - Drive with ecstasy in system – no conviction recorded, licence saved
We represented a client who was on a working visa from Britain. She was charged with driving whilst there was ecstasy present in her blood.
The client was concerned about receiving a conviction.
We advised the client to undertake the Traffic Offenders Programme and assisted her in obtaining subjective evidence to support her otherwise good character.
On a plea of guilty, submissions were made to the Court seeking that the client be given a second chance, taking into account her previous good character, good driving record and attendance at the Programme.
Her Honour accepted the submissions and dismissed the matter pursuant to section 10 of the Crimes (Sentencing Procedure) Act without recording a conviction.
Although the client was pleased that she could continue driving, she was more relieved that she escaped without a criminal conviction.
