Serious Assault Charge - Section 10 Dismissal

Client was charged with assaulting his wife by slapping her across the face and causing temporary injury.

After obtaining detailed instructions, we strongly advised the client to take an anger management course, to assist him personally and to allow him an opportunity to display to the Court that he was remorseful for his actions and wished to ensure that a similar incident did not reoccur.

After considering the evidence of the victim, we managed to negotiate with the police changes to the factual allegations (Facts Sheet) to reflect a little more favourably on the client.

We were able to make strong submissions on his behalf to persuade the Court to dismiss the matter pursuant to section 10 of the Crimes (Sentencing Procedure) Act, without a conviction being recorded.
